NOTICE OF TRUSTEE’S SALE OF REAL ESTATE

Default having been made in the payment of the debts and obligations secured by a certain Deed of Trust securing a promissory note, said Deed of Trust being executed on October 22, 2013, by Conan Hall and wife, Cornelia Hall to Larry F. McKenzie, Trustee, as same appears of record in the Register’s Office of Chester  County, Tennessee, in Record Book 380, page 175 filed of record on October 28, 2013 at 2:11 pm to secure an indebtedness to West Tennessee Bank, a Division of Decatur County Bank, in the original principal amount of Twenty-Eight Thousand, Nine Hundred and Ninety-Four and 04/100 ($28,994.04) Dollars; and

WHEREAS, Donald D. Glenn was appointed as substitute trustee by Appointment of Substitute Trustee recorded in Record Book 448 page 627 in said Register’s Office; and 

WHEREAS the holder of the note, West Tennessee Bank, a Division of Decatur County Bank, which is the owner of the debt secured having declared the total indebtedness due, pursuant to said promissory note and trust deed at the option of the same, having requested the undersigned to advertise and sell the property described in and conveyed by said Deed of Trust;

NOW, THEREFORE, by virtue of the authority in me vested as trustee under said instrument, this is to give notice that I will, on October 25, 2019 at 11:00 a.m., proceed to offer for sale and sell at public outcry at the front door of the Chester County Courthouse in Henderson, Chester County, Tennessee (the door facing Main Street) and to the highest and best bidder for cash, the following described property, to wit:

Beginning at a point in the centerline of Silerton Road, which point is the southeast corner of Nadine Carroll as recorded in Record Book 125, page 390, Register’s Office of Chester County, Tennessee; thence, from the point of beginning, and with lines of Carroll, the following calls; north 25° 14′ 54″ west 1087.11 feet to an iron pipe found; north 40° 47′ 09″ east 207.96 feet to an iron pipe found in the west line of Shine Daniel as recorded in Deed Book 65, page 96, Register’s Office of Chester County, Tennessee; thence, with lines of Daniel, the following calls; south 35° 55′ 03″ east 355.76 feet; south 55° 15′ 54″ east 205.50 feet to the northwest corner of Hall Farms Processing as recorded in Record Book 128, page 689, Register’s Office of Chester County, Tennessee; thence, with lines of Hall and generally following a ditch, the following calls; south 39° 53′ 00″ east 232.59 feet; south 45° 41 ‘ 27″ east 113.13 feet; south 18° 40′ 59″ east 134.84 feet; south 13° 20′ 53″ east 176.57 feet to the centerline of Silerton Road; thence, with the centerline of Silerton Road, the following calls; south 65° 18′ 55″ west 273.16 feet; south 60° 52’ 43″ west 132.30 feet to the point of beginning, containing 9.0 acres, as surveyed by Advanced Land Surveying, Inc., R.L.S. # 1999 on August 10, 2004.

Being the same property conveyed to Conan Hall and Cornelia Hall by quit-claim deed of record in Record Book 258, Page 146 in the Register’s Office of Chester County, Tennessee.

Beginning at a point in the centerline of Silerton Road, which point is the southwest corner of Dennis Emerson as recorded in Deed Book 68, page 124, Register’s Office of Chester County, Tennessee; thence, from the point of beginning, and with the centerline of Silerton Road, the following calls; south 79° 35′ 47″ west 181.51 feet; south 72° 06′ 48″ west 121.16 feet to the southeast corner of Dwight Emerson as recorded in Record Book 225, page 622, Register’s Office of Chester County, Tennessee; thence, with lines of Emerson and generally following a ditch, the following calls; north 13° 20′ 53″ west 176.57 feet; north 18° 40′ 59″ west 134.84 feet; north 45° 41′ 27″ west 113.13 feet to the southeast corner of the remainder of Conan Hall property as recorded in Deed Book 90, page 747; thence, with Hall, and generally following a ditch, north 39′ 53′ 00″ west 232.59 feet to the southwest corner of Shine Daniel; thence, with the south line of Daniel, north 67° 14′ 48″ east 181.71 feet to an iron pipe found at the northwest corner of Dennis Emerson; thence, with the west line of Emerson, south 38 18′ 36″ east 710.27 feet to the point of beginning, containing 3.0 acres, as surveyed by Advanced Land Surveying. Inc., R.L.S. # 1999 on August 10, 2004.

Being the same property conveyed to Cornelia Hall by quit-claim deed of record in Record Book 258, Page 144 in the Register’s Office of Chester County, Tennessee.

The mailing address of this property is believed to be 4375 Silerton Road, Henderson TN and then also another approximately 3 acre tract on Silerton Road in Chester County, Tennessee.

All right of redemption, statutory and otherwise, homestead and dower are expressly waived in said Deed of Trust, and the title is believed good, but the undersigned, Trustee, will sell and convey only as Trustee, subject to any prior deeds of trust, real estate taxes, assessments, covenants, easements, restrictions and liens.

Pursuant to T.C.A. § 35-5-104, the following liens or claimed liens of the United States or the State of Tennessee are of record in said Register’s office: Record Book 405, Page 53.  If necessary, notice of the Trustee’s foreclosure sale has been given to the Internal Revenue Service or the State of Tennessee as provided for in U.S.C. § 7425(b) and/or T.C.A. § 67-1-1433(b)(1) h.  If applicable, the sale of this property is subject to any applicable redemption rights held by the United States Internal Revenue Service, as set out in 26 U.S.C. § 7425(d)(1) or the State of Tennessee, as set out in T.C.A. § 67-1-1433(c)(1).

Other interested parties whose interest may be extinguished by this foreclosure are as follows: The Internal Revenue Service pursuant to Notice of Federal tax Lien of record in Record Book 405, page 53.  West Tennessee Bank, a Division of Decatur Cunty Bank also has a junior mortgage of record at Record Book 425, Page 75.

For information purposes: Chester County Real Estate taxes have been paid through 2017. Taxes for 2018 are due, payable and delinquent.

 The Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale.  If the highest bidder cannot pay the bid in full upon such terms as are announced at the sale, the next highest bidder, at their highest bid, will be deemed the successful bidder. The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.  

A copy of this notice as required by T.C.A. §35-5-101 is being sent to the debtor.

The Trustee caused the records check to be done to insure that the borrowers are not subject to the Service-members Civil Relief Act.
