, 53, Etowah, was found guilty of counts one/two/three (merged) class A misdemeanor, first offense driving under the influence, and was sentenced to three years in a TDOC facility at 35 percent release eligibility, receiving credit for time served pretrial, and was ordered to pay court costs plus $3,000 in fines, with driving license revoked for eight years following serving of sentence, with ignition interlock required for restricted license during revocation period. Allen was found guilty of counts four/five (merged), class A misdemeanor driving while license revoked – second or subsequent, and sentenced to 11 months and 29 days in the Chester County Jail, with credit for time served pretrial, 75 percent minimum service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. He was found guilty of count six, class C misdemeanor, violation of the vehicle registration law, and was sentenced to 30 days in the Chester County Jail, with credit for time served pretrial, a minimum of 75 percent service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. Allen was found guilty of count seven, class C misdemeanor, violation of the vehicle financial responsibility act, receiving credit for time served pretrial, and ordered to pay $1 in fines. He was found guilty of count eight, class C misdemeanor driving on the right, and was sentenced to 30 days in the Chester County Jail with credit for time served pretrial, a minimum of 75 percent service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. Allen was also found guilty of count nine, class C misdemeanor drivers to exercise due care, and sentenced to 30 days in the Chester County Jail with credit for time served pretrial, to serve a minimum of 75 percent service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. He was ordered to pay all court costs, and all counts are concurrent. He was found guilty by jury on counts one, two, four, six, seven, eight and nine, and pled guilty to count five after jury verdict. On count three, Allen stipulated to the priors alleged in the indictment and a bench trial was held as to whether it should be a DUI third or fourth under the DUI enhancement statute. Court ruled it was DUI fourth.
