NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF REAL ESTATE

WHEREAS, on July 2, 2021, KIMBERLY L. SMITH, by Deed of Trust of record in Record Book 477, at Page 623, in the Register’s Office of Chester County, Tennessee, conveyed the following described property in trust to secure the payment of a Promissory Note in the original principal amount of Sixty Thousand and 00/100 Dollars ($60,000.00), payable to Leaders Credit Union; and
WHEREAS, the undersigned was appointed Substitute Trustee by Leaders Credit Union the legal owner and holder of the said Note, by an appointment dated January 24, 2024, of record in Record Book 513, at Page 483, in the Register’s Office of Chester County, Tennessee; and
WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and Leaders Credit Union, the lawful owner and holder of the said indebtedness, has declared the entire amount due and payable as provided by the Deed of Trust in accordance with the terms thereof, and instructed the undersigned to foreclose.

SUBSTITUTE TRUSTEE’S NOTICE OF SALE
Sale at public auction will be on April 24, 2024, at or about 11:00 AM, local time, at the front entrance to the Chester County Courthouse,133 East Main Street, Henderson, TN 38340, pursuant to the Deed of Trust executed by Wesley A Denbow and Keri Leigh Denbow, husband and wife, to Susan Voss, as Trustee for Regions Bank d/b/a Regions Mortgage dated March 11, 2016, and recorded on March 11, 2016, in Book 406, Page 346, Instrument No. 53350, in the Register’s Office for Chester County, Tennessee (“Deed of Trust”), conducted by Padgett Law Group, having been appointed Substitute Trustee, all of record in the Chester County Register’s Office. Default in the performance of the covenants, terms, and conditions of said Deed of Trust has been made; and the entire indebtedness has been declared due and payable.

The hereinafter described real property located in Chester County will be sold to the highest call bidder subject to all unpaid taxes, prior liens and encumbrances of record:
Legal Description: BEGINNING at an iron pin set in the West margin of Marnie Loop, which point is the Southeast corner of lot 34; Thence, from the point of beginning, and with the West margin of Marnie Loop, South 02 degrees 18 minutes 43 seconds West 90.00 feet to an iron pin set at the Northeast corner of Lot 36; Thence, with the North line of lot 36 and lot 37, North 87 degrees 41 minutes 17 seconds West 207.69 feet to an iron pin in the East line of Allison Arnold; Thence, with the East line of Arnold, North 01 degrees 28 minutes 13 seconds East 90.01 feet to an iron pin set at the Southwest corner of lot 34; Thence, with the South line of lot 34, South 87 degrees 41 minutes 17 seconds East 209.01 feet to the point of beginning, containing 0.4 acres, being Lot 35 Cloverdale Subdivision.
This is the identical real estate conveyed to Wesley A. Denbow and wife, Keri Leigh Denbow from Dustin W. Insell by Warranty Deed dated March 11, 2016, of record in the Registers Office of Chester County, Tennessee in Record Book 406, page 344. SUBJECT TO A SOUTHWEST EASEMENT AS SHOWN OF RECORD IN THE REGISTERS OFFICE OF CHESTER COUNTY, TENNESSEE, IN RECORD BOOK 255, PAGE 349.
SUBJECT TO RESTRICTIVE COVENANTS AS SHOWN OF RECORD IN THE REGISTERS OFFICE OF CHESTER COUNTY, TENNESSEE, IN RECORD BOOK 273, PAGE 561. SUBJECT TO CERTAIN SETBACKS, RESTRICTIONS, EASEMENTS, AND ALL OTHER MATTERS OF RECORD AS SHOWN ON THE PLAT OF RECORD IN PLAT CABINET, SECTION 5, PAGE 81, IN THE REGISTERS OFFICE OF CHESTER COUNTY, TENNESSEE.

This sale is subject to all matters shown on any applicable recorded Plat or Plan; any unpaid taxes and assessments; any restrictive covenants, easements or setback lines that may be applicable; rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of Trust, including rights of redemption of any government agency, state or federal; and any and all prior deeds of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters that may take priority over the Deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this Foreclosure Sale.

The title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
The right is reserved to adjourn the sale to another time certain or to another day, time, and place certain, without further publication upon announcement on the day, time, and place of sale set forth above or any subsequent adjourned day, time, and place of sale.
If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified check made payable to or endorsed to Padgett Law Group. No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered.
