WHEREAS, Elizabeth Dove executed a Deed of Trust to Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for First State Bank, Lender and John Clark, Trustee(s), which was dated April 9, 2008, and recorded on April 10, 2008, in Book 313, at Page 644 in Chester County, Tennessee Register of Deeds. WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, Tennessee Housing Development Agency, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on December 10, 2024, at 10:00 AM at the usual and customary location at the Chester County Courthouse, Henderson, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Chester County, Tennessee, to wit:
BEGINNING at an angle iron found in the north margin of Smith Road, which point is the southeast corner of Thomas Connor as recorded in Deed Book 72, Page 735, Register’s Office of Chester County, Tennessee; thence from the point of beginning and with the east line of Connor, north 03° 26’ 56” west 576.45 feet to an iron pin set; thence on new lines through Teague the following calls: north 89° 59’ 48” east 185.34 feet to an iron pin set; south 03° 26’ 56” east 235.43 feet to an iron pin set in the north margin of Smith Road; thence with the north line of Smith Road, south 89° 59’ 48” west 185.33 feet to the point of beginning, containing 1.0 acre as surveyed by Advanced Land Surveying Inc. RLS #1999 being known as Lot 1 Teague Trace Subdivision. This is the identical real estate conveyed to Elizabeth Dove from Anthony Moody by Warranty Deed dated April 9, 2008, of record in the Register’s Office of Chester County, Tennessee in Record Book 313, Page 642. SUBJECT TO THE RESTRICTIONS FOR TEAGUE TRACE SUBDIVISION AS SHOWN OF RECORD IN THE REGISTER’S OFFICE OF CHESTER COUNTY, TENNESSEE IN RECORD BOOK 287, PAGE 682 AND AMENDED RESTRICTIONS OF RECORD IN RECORD BOOK 293, PAGE 166. Parcel ID Number: 017 027.03 Address/Description: 375 SMITH RD, Luray, TN 38352 Current Owner(s): Elizabeth Dove Other Inbterested Party(ies): Portfolio Recovery Associates, LLC as successor in interest to “COMENITY BANK” The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or setback lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and all right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. Estate of Billy Joe Phillips, Deceased
Notice is hereby given that on the 21st day of October, 2024, Billy Joe Phillips (“Decedent”) passed away in Chester County, Tennessee. Pursuant to the laws of the State of Tennessee, all persons having claims against the estate of the Decedent are required to present their claims.
All claims must be sent by certified mail, return receipt requested, to Jay L. Johnson, Attorney at Law, the duly appointed representative of the Decedent’s estate, at the following address:
