NOTICE TO CREDITORS

Notice is Hereby Given that on 3-26-2024, Letters Testamentary, of Administration, in respect to the Estate of Roberta Patrick deceased, were issued to the undersigned by the Chancery Court of Chester County, Tennessee.
All persons, resident and non-resident, having claims, matured or unmatured, against his/her Estate are required to file the same with the Clerk of the above-named Court, within four (4) months from the date of the first publication (or of the posting, as the case may be) of this notice, otherwise their claim will be forever barred.
All persons indebted to the above Estate must come forward and make proper settlement with the undersigned at once.

SUBSTITUTE TRUSTEE’S NOTICE OF FORECLOSURE SALE

 Default having been made in the terms, conditions, and payments provided in a certain Deed of Trust dated OCTOBER 10, 2014, executed by JOEL HARVEY, UNMARRIED MAN;  to SUSAN VOSS,  Trustee, of record in RECORD BOOK 390, PAGE 677, for the benefit of REGIONS BANK D/B/A REGIONS MORTGAGE, in the Register’s Office for CHESTER County, Tennessee and to J. PHILLIP JONES AND/OR JESSICA D. BINKLEY, either of whom may act, appointed as Substitute Trustee in an instrument of record in the Register’s Office for CHESTER County, Tennessee, to secure the indebtedness described; the entire indebtedness having been declared due and payable by REGIONS BANK D/B/A REGIONS MORTGAGE, being the present owner/holder or authorized agent, designee or servicer of the holder/owner of said indebtedness, has requested foreclosure proceedings to be instituted; and as provided in said Deed of Trust, I, J. SAID LEGAL DESCRIPTION IS THE SAME DESCRIPTION AS CONTAINED IN THE PREVIOUS DEED OF RECORD.
BEING THE SAME PROPERTY CONVEYED TO JOEL HARVEY BY WARRANTY DEED DATED OCTOBER 10, 2014, OF RECORD IN THE REGISTER’S OFFICE OF CHESTER COUNTY, TENNESSEE IN RECORD BOOK 390, PAGE 675.

THE SALE OF THE SUBJECT PROPERTY IS WITHOUT WARRANTY OF ANY KIND, AND IS FURTHER SUBJECT TO THE RIGHT OF ANY TENANT(S) OR OTHER PARTIES OR ENTITIES IN POSSESSION OF THE PROPERTY. NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF REAL ESTATE

WHEREAS, on October 4, 2017, SAMUEL D. ROBISON AND LILAH E. ROBISON, by Deed of Trust of record in Record Book 426, at Page 321, in the Register’s Office of Chester County, Tennessee, conveyed the following described property in trust to secure the payment of a Promissory Note in the original principal amount of Thirty-Eight Thousand and 00/100 Dollars ($38,000.00), payable to The Bank of Milan; and
WHEREAS, the undersigned was appointed Substitute Trustee by THE BANK OF MILAN, the legal owner and holder of the said Note, by an appointment dated April 2, 2024 and of record in Record Book 516, at Page 24, in the Register’s Office of Chester County, Tennessee; and
WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and THE BANK OF MILAN, the lawful owner and holder of the said indebtedness, has declared the entire amount due and payable as provided by the Deed of Trust in accordance with the terms thereof, and instructed the undersigned to foreclose.
NOW, THEREFORE, the public is hereby notified that the undersigned Substitute Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand paid in certified funds paid at the conclusion of the sale, or upon a credit bid from a bank or other lending entity pre-approved by the Substitute Trustee. The auction shall occur at the south door of the Courthouse at Henderson, Chester County, Tennessee, on Monday, May 6, 2024, at 2:00 o’clock p.m., said property to be sold in bar of the equity of redemption and subject to the lien of all special assessments against it.
Lying, and being situate in the 7th Civil District of Chester County, Tennessee, bounded and described as follows; to-wit:
BEGINNING at a point in the south margin of the Mayfield Road at a point located 314.5 feet west of the northwest corner of Taylor; runs thence with the margin of said road North 77 degrees 35 minutes West 105 feet; runs thence South 12 degrees and 25 minutes West 420 feet; runs thence South 77 degrees and 35 minutes East 105 feet; thence North 12 degrees and 25 minutes East 420 feet to the point of beginning, containing 1 acre. Description taken from Deed Book 72, page 69.
This being the same property as that described in a Warranty Deed from Anita Kay Tucker and Annette R. Evans to Samuel D. Robison and wife, Lilah E. Robison, dated July 26, 1999, as recorded in Book 176, page 257, in the Register’s Office of Chester County, Tennessee.

The street address of the above-described property is believed to be 505 Patterson Lane, Finger, TN 38334, but such address is not part of the legal description and in the event of any discrepancy, the legal description herein shall control.
SALE IS SUBJECT TO TENANT(S) RIGHTS IN POSSESSION, IF ANY.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. Other interested parties: None.
Title to said property is believed to be good, but the undersigned will sell as Substitute Trustee only and will assign to the purchaser all covenants of warranty contained in said Deed of Trust.
The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. Said sale may be adjourned to another time or may be postponed to another date by public announcement at the appointed time of sale without readvertisement.
This office is a debt collector. This is an attempt to collect a debt and any information obtained will be used for that purpose.
