NOTICE OF SUCCESSOR TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Note dated June 9, 2023, and the Deed of Trust of even date, securing said Note recorded June 13, 2023 in Book 506, at Page 94-105, as Document #73647, in the Register’s office for CHESTER County, Tennessee, executed by ANDREW G GRICE AND JOCELYN R SMITH, BOTH UNMARRIED, AS JOINT TENANTS WITH RIGHT OF SURVIVORSHIP, conveying the certain property described therein to CARTER, STANFILL, & ASSOCIATES, PLLC, Trustee, for the benefit of MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. (“MERS”), AS BENEFICIARY, AS NOMINEE FOR STOCKTON MORTGAGE CORPORATION its successors and assigns and to MARINOSCI LAW GROUP, P.C., having been appointed as Successor Trustee by instrument of record July 1, 2025 in the Register’s office for CHESTER County, Tennessee in Book 533, at Page 399-400, as Document #79196.
WHEREAS, the owner and holder of the Note has declared the entire indebtedness due and payable and demanded that the hereinafter described real property be advertised and sold in satisfaction of indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust.
NOW, THEREFORE, notice is hereby given that an agent of Marinosci Law Group, P.C., as Successor Trustee, pursuant to the power, duty and authority vested in and conferred upon said Successor Trustee, by the Deed of Trust, will on October 8, 2025 at 11:00 AM at the front entrance of the Chester County Courthouse, 133 East Main Street, Henderson, TN 38340 offer for sale to the highest bidder for cash, and free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Chester County, Tennessee, described as follows:
TRACT ONE: BEGINNING on an iron pipe in the west right of way line of Crook Avenue, this point being the northeast corner of Hatch lot; runs thence with the north boundary line of Hatch lot north 88 57’ west 179.64 feet to an old iron stake, the northwest corner of Hatch lot, and the southeast corner of Simmons lot; runs thence north 4 34’ west 98.06 feet to a stake in the south boundary line of Parsons lot; runs thence with the south boundary line of Parsons lot south 89 34’ east 184.22 feet to an iron stake in the west right of way line of Crook Avenue: runs thence with the west right of way line of Crook Avenue south 1 51’ east 99.71 feet to the point of beginning, containing 0.412 acre, more or less. Said legal description is the same description as contained in the previous deed of record. TRACT TWO: BEGINNING at a stake in the southeast corner of the tract of land above described at a point where the eastern boundary line of said tract intersects the northern boundary line of the Luther Smith Estate property; runs thence east 64 1/2 feet to a stake in F.R. Weeks’ present southwest corner; runs thence north with F.R. Weeks’ present western boundary line 100 feet to a stake at F.R. Weeks northwest corner; runs thence west 61 1/2 feet to a stake in the eastern boundary line of the First Tract described in Deed Book No. 49, page 326, Register`s Office of Chester County, Tennessee; runs thence south 5 east with the eastern boundary line of said First Tract in Deed Book No. 49, page 326, said Register`s Office, 100 feet to the point of beginning.
INCLUDED IN THE ABOVE DESCRIPTION BUT EXPRESSLY EXCLUDED THEREFROM IS THE FOLLOWING DESCRIBED TRACT OF REAL ESTATE: Beginning at a stake in the southeast corner of the tract of land described at a point where the eastern boundary line of said tract intersects the northern boundary line of the Luther Smith (now Kerr Property): runs thence east 10 feet to a point in center of drainage ditch, Barnes’ southwest corner; runs thence north with Barnes’ western boundary line 100 feet to point in Barnes northwest corner; runs thence west 10 feet to stake in eastern boundary line of Claudie Malone, et ux. tract described in Record Book 234, page 472 in the Register`s Office of Chester County, Tennessee: runs thence south 50 east with the eastern boundary line of said first tract in Record Book 234, page 472 in the said Register`s Office 100 feet to point of beginning. This is the identical real estate conveyed to Claudie A. Malone and wife, Stella A. Malone from Bobby Barnes and wife, Allison Barnes by Quit-Claim Deed dated September 10, 2003 of record in the Register`s Office of Chester County, Tennessee in Record Book 240, page 691.
Being the same property conveyed to Andrew G. Grice and Jocelyn R. Smith by Lymon E. Parsons by Warranty Deed dated June 9, 2023 and of record in Record Book 506, page 92 in the Register’s Office of Chester County, Tennessee.More Commonly Known As: 241 CROOK AVE, HENDERSON, TN 38340
Said sale shall be held subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; to any matter that an accurate survey of the premises might disclose; and subject to, but not limited to, the following parties who may claim an interest in the above-referenced property: ANDREW G GRICE, JOCELYN R SMITH, UNITED STATES OF AMERICA ON BEHALF OF THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT, OCCUPANTS/TENANTS OF 241 CROOK AVE, HENDERSON, TN 38340.
To the best of the Successor Trustee’s knowledge, information, and belief, there are no other Federal or State tax lien claimants or other claimants upon the subject property which would require notice pursuant to the terms and provision of T.C.A. § 35-5-104 or T.C.A. § 67-1-1433 or 26 U.S.C. § 7425.
The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The Successor Trustee may postpone the above referenced sale from time to time as needed without further publication. The Successor Trustee will announce the postponement on the date and at the time and location of the originally scheduled sale.
This is an attempt to collect a debt, and any information obtained will be utilized for that purpose.
