NOTICE OF FORECLOSURE SALE
STATE OF TENNESSEE, CHESTER COUNTY
WHEREAS, Robert C. Cupples and Anita Cupples executed a Deed of Trust to United States of America acting through the Rural Housing Service or successor agency, United States Department of Agriculture, Lender and Mary Ruth Tackett, Trustee(s), which was dated April 22, 2008, and recorded on April 23, 2008, in Book 314, at Page 286 in Chester County, Tennessee Register of Deeds.
WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, United States Department of Agriculture Rural Housing Service (RHS), formerly Farmers Home Administration, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on June 20, 2023, at 10:00 AM at the usual and customary location at the Chester County Courthouse, Henderson, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Chester County, Tennessee, to wit:
BEGINNING at the intersection of a gravel drive with the centerline of Old Jackson Road, which point is the southeast corner of the herein described tract; thence from the point of beginning and with the centerline of Old Jackson road north 56° 13’ 16” west 238.00 feet to the southeast corner of Massey (Record Book 135, Page 308); thence with the east line of Massey, north 03° 36’ 44” west 155.68 feet to the southwest corner of Smith (Record Book 179, Page 504); thence south 61° 36’ 44” east 261.21 feet to a point in the centerline of a gravel drive; thence south 07° 43’ 21” west with the centerline of said drive for 165.00 feet to the point of beginning, containing 0.80 acres as surveyed by Advanced Land Surveying Inc. R.L.S, #1999 on April 14, 2008.
This is the same real estate conveyed to Robert C. Cupples and wife, Anita Cupples from Kok Hai Tan by Warranty Deed dated April 22, 2008, of record in the Register’s Office of Chester County, Tennessee, in Record Book 314, Page 284.
SUBJECT TO A NON-EXCLUSIVE EASEMENT RESERVED BY BILL HUNT AND WIFE. BOBBIE HUNT IN DEED BOOK 89, PAGE 863, ACROSS THE EASTERN SIDE OF THE ABOVE LOT OVER THE ABOVE MENTIONED DRIVEWAY, AS A MEANS OF INGRESS AND EGRESS FROM THE HENDERSON-JACKSON OLD BLACK TOPPED ROAD TO THE REAL ESTATE WHICH BILL HUNT, ET UX., OWNS ON THE NORTHER SIDE OF THE ABOVE LOT.
SUBJECT TO THE RESTRICTIVE COVENANTS AS SHOWN OF RECORD IN THE REGISTER’S OFFICE OF CHESTER COUNTY, TENNESSEE IN DEED BOOK 89, PAGE 860.
SUBJECT TO AN EASEMENT ALONG THE NORTHERN BOUNDARY LINE OF THE LOT HEREIN CONVEYED 15 FEET IN WIDTH FOR THE INSTALLATION, OPERATION, AND REPAIR OF THE UNDERGROUND UTILITIES INCLUDING WATER SEWER AND GAS.
