SUBSTITUTE TRUSTEE’S NOTICE OF SALE
Sale at public auction will be on May 13, 2025, at or about 11:00 AM, local time, at the front entrance to the Chester County Courthouse,133 East Main Street, Henderson, TN 38340, pursuant to the Deed of Trust executed by Melonie D Black and Neil M Black, as joint tenants with full rights of survivorship, to John Talbott Law Firm, as Trustee for Mortgage Electronic Registration Systems, Inc., solely as nominee for Society Mortgage dated November 21, 2023, and recorded on November 27, 2023, in Book 511, Page 521, Instrument No. 74800, in the Register’s Office for Chester County, Tennessee (“Deed of Trust”), conducted by Padgett Law Group, having been appointed Substitute Trustee, all of record in the Chester County Register’s Office. Default in the performance of the covenants, terms, and conditions of said Deed of Trust has been made; and the entire indebtedness has been declared due and payable.

The hereinafter described real property located in Chester County will be sold to the highest call bidder subject to all unpaid taxes, prior liens and encumbrances of record:

Tract1:
BEGINNING on an iron stake in the center of Hendeson - Montezuma old road at the northeast corner of the R. B. Wood home tract; runs thence east with said road 18 poles to a stake; thence south 37 poles to an iron stake; thence west 18 poles to a stake; thence north 37 poles to the beginning.
Tract 2:
BEGINNING at a stake in the center of Henderson - Montezuma Road, the northwest corner of the T. R. Hurst 4 acre tract (the above described tract of land); runs thence south 37 poles to a stake; thence east 4 -1/3 poles to a stake; thence north 37 to a stake in the Henderson - Montezuma road; thence west 4 -1/3 poles with said road to the point of beginning.
INCLUDED IN THE ABOVE-DESCRIBED REAL PROPERTY BUT HEREBY EXCLUDED FROM THIS CONVEYANE ARE THE FOLLOWING PARCELS OF REAL PROPERTY:

BEGINNING at a stake in the center of the Henderson - Montezuma Old Road (West Main Street) at the northeast corner of the Carl Stavros home tract; runs thence east with the center of said Henderson - Montezuma Old Road 99 feet to a stake in the western severance line of Welch; runs thence south with the western severance line of Welch, 610.5 feet to a stake in the northern line of Harrison; runs thence west with Harrison 99 feet to a stake at the southeast corner of the Carl Stavros home tract; runs thence north with the eastern line of the Carl Stavros home tract, 610.5 feet to the place of beginning.
Exclusion 2:
BEGINNING at a PK nail found in the south margin of Sanford Street, which point is the northwest corner of Brian Welch as recorded in Record Book 249, page 42 Register`s Office of Chester County, Tennessee, thence, from the point of beginning, and with the west line of Brian Welch, south 00° 34` 48” west 84.00 feet; thence, on new lines through Leonard Welch, the following calls; north 89° 22` 13” west 8.0 feet to an iron pin set; north 00° 34` 48” east 84.00 feet to an iron pin set in the south margin of Sanford Street; thence with the south margin of Sanford Street, south 89° 22` 13” east 8.0 feet to the point of beginning.

Being the same property conveyed to Leornard Welch and wife, Ruth Welch by Warranty Deed of record in Book 61, Page 26, recorded 07/23/1973, in the Register`s Office of Chester County, Tennessee.

This sale is subject to all matters shown on any applicable recorded Plat or Plan; any unpaid taxes and assessments; any restrictive covenants, easements or setback lines that may be applicable; rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of Trust, including rights of redemption of any government agency, state or federal; and any and all prior deeds of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters that may take priority over the Deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this Foreclosure Sale.
THE PROPERTY IS SOLD WITHOUT ANY REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, RELATING TO TITLE, MARKETABILITY OF TITLE, POSSESSION, QUIET ENJOYMENT OR THE LIKE AND FITNESS FOR A GENERAL OR PARTICULAR USE OR PURPOSE. The title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
The right is reserved to adjourn the sale to another time certain or to another day, time, and place certain, without further publication upon announcement on the day, time, and place of sale set forth above or any subsequent adjourned day, time, and place of sale.
If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified check made payable to or endorsed to Padgett Law Group. No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered.
This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. This sale may be rescinded by the Substitute Trustee at any time.
