Justin Aaron Burnette, 36, in case 25-CR-56, was found guilty by jury verdict of count one, class D felony evading arrest risk of death or injury – vehicle involved and was sentenced to five years and six months in a TDOC facility at 35% service prior to release eligibility, receiving credit for time served pretrial. He was found guilty by jury of count two, class A misdemeanor reckless endangerment – no weapon involved and was sentenced to 11 months and 29 days in the Chester County Jail, with credit for time served, a minimum of 75% service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. He was found guilty by jury of counts four/five (merged), class B misdemeanor driving on revoked for DUI conviction, second, and was sentenced to six months in the Chester County Jail, with credit for time served, a minimum of 75% service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. He was found guilty by jury of count six, class C misdemeanor light law – motor vehicle, and was ordered to pay all court costs. Burnette was found guilty by jury of count seven, class C misdemeanor driving on roadways laned for traffic and was ordered to pay costs. All counts are concurrent with each other. Count three, class A misdemeanor evading arrest was dismissed.

Jackie Elaine Miner, 68, in case 25-CR-46, pled guilty to count two, class C felony vehicular homicide by recklessness and was sentenced to three years in a TDOC facility at 100% service prior to release eligibility, receiving credit for time served pretrial. She pled guilty to count four, class C felony vehicular homicide by recklessness and was sentenced to four years in a TDOC facility at 100% service prior to release eligibility, with credit for time served pretrial, all suspended and supervised, and was ordered to complete 48 hours of unpaid community service. She pled guilty to count five, class D felony vehicular assault and was sentenced to four years in a TDOC facility at 30% service prior to release eligibility, with credit for time served, all suspended and supervised, and ordered to complete 48 hours of unpaid community service. She pled guilty to count six, class D felony aggravated assault – reckless and was sentenced to four years in a TDOC facility at 30% service prior to release eligibility, with credit for time served, all suspended and supervised, and ordered to complete 48 hours of unpaid community service. She pled guilty to count seven, class A misdemeanor Driving Under the Influence – First offense, and was sentenced to 11 months and 29 days in the Chester County Jail, with credit for time served, a minimum of 75% service prior to eligibility for work release, furlough, trusty status or rehabilitative programs and ordered to pay all court costs plus $350 in fines. She pled guilty to count eight, class C misdemeanor driving on roadways laned for traffic and was sentenced to 30 days in the Chester County Jail, with credit for time served, a minimum of 75% service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. She pled guilty to count nine, class C misdemeanor speeding and was sentenced to 30 days in the Chester County Jail with credit for time served, a minimum of 75% service prior to eligibility for work release, furlough, trusty status or rehabilitative programs. Count one, class B felony vehicular homicide driver intoxication and Count three, class B felony vehicular homicide driver intoxication are processed Nolle Prosequi without costs. Defendant is to have no contact of any kind with witnesses or victims, must maintain full-time employment or be a full-time student, must submit to an alcohol and drug evaluation and follow recommendations, must submit to random drug and alcohol screens, must complete DUI Safety School and MADD Victim Impact Panel within six months. Driving privileges are revoked for a period of 10 years. Counts seven, eight and nine are concurrent with each other and concurrent with count two. Counts five and six are concurrent with each other and with count four. Count four is consecutive to count two. It is not the intent of the court for duplication of jail credit to be applied to consecutive sentences.
