Notice is Hereby Given that on November 28, 2023, Letters Testamentary, of Administration, in respect to the Estate of Danny Capps, deceased, were issued to the undersigned by the Chancery Court of Chester County, Tennessee.
All persons, resident and non-resident, having claims, matured or unmatured, against his Estate are required to file the same with the Clerk of the above-named Court, within four (4) months from the date of the first publication (or of the posting, as the case may be) of this notice, otherwise their claim will be forever barred.
All persons indebted to the above Estate must come forward and make proper settlement with the undersigned at once.

NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated December 31, 2010, and the Deed of Trust of even date securing the same, recorded January 5, 2011, in Book No. 346, at Page 793, in Office of the Register of Deeds for Chester County, Tennessee, executed by Regina A King, conveying certain property therein described to Arnold M. Weiss, Esq. as Trustee for Wells Fargo Bank, N.A.; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Wells Fargo Bank, N.A..
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Wells Fargo Bank, N.A., will, on January 31, 2024 on or about 11:00 AM, at the Chester County Courthouse 133 East Main Street, Henderson, TN 38340, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Chester County, Tennessee, and being more particularly described as follows:
The following described property: Located in the Seventh Civil District, Chester County, Tennessee, more particularly bounded and described as follows, to wit: Beginning at an iron pin on the West margin of Harmony Lane (25 feet at right angles from centerline} at the Southeast corner of Lot 2B, Section III, Harmony Acres as recorded in Plat Cabinet 1, Section III, Page 28 in the Register’s Office of Chester County, Tennessee: thence with the West margin of Harmony Lane, South 0 degrees 15’ 51” West a distance of 118 feet to an iron pin at the Northeast corner of Lot 1: thence with the North line of Lot 1, North 89 degrees 22’ 17” West a distance of 431.60 feet to an iron pin on the East margin of Highway 45 (right of way varies): thence with the East margin of Highway 45, North 1 degree 32’ 36” West a distance of 23.55 feet to a point: thence North 0 degrees 53’ 41” East a distance of 83.83 feet to an iron pin at the Southwest corner of Lot 28; thence with the South line of Lot 2B, North 89 degrees 12’ 58” East a distance of 431.48 feet to the point of beginning. Being Lot 2A, Section III, Harmony Acres as shown on a Plat of this Subdivision, in Plat Cabinet 1, Section III, Page 28, as surveyed by David Hall Land Surveying Company, RLS No. 943 on April 28, 1998.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed and that notices of said postponement for inclement weather will be mailed to interested parties of record.
